Terms of business

This page explains how we work with you, in plain language rather than legal wording. We will ask your solicitor or accountant to review it before it becomes the final contract wording, and we will confirm the agreed terms on each quote.

Who you are dealing with

Mighty Health Creatives Ltd. Registered in England & Wales, company number 14702669. Registered office: 66 Paul Street, London EC2A 4NA. VAT number 475542176. Contact: hello@mightyhealthcreatives.com.

How we work

Every project starts with your brief. Mighty Studio leads the work, and we bring in specialist support only where a project needs extra expertise, capacity or speed. We handle scoping, quotation, delivery, review and invoicing, and you have one point of contact throughout.

Sending a brief is not a confirmed booking. Work begins after you accept the current quote and any deposit or purchase-order conditions are in place.

Quotes and approvals

  • Every quote is prepared individually for your project — there are no automatic estimates.
  • Each quote shows its own validity date. Only the current, unexpired version can be accepted.
  • If the scope changes, we issue a new quote version; the old version is superseded and cannot be accepted.
  • Acceptance is recorded against a named approver at your organisation.

Deposits and payment

  • Jobs over £15,000 net: a 25% deposit is payable before work starts.
  • All other work: payment is due 30 days from the invoice date.
  • Payment is by bank transfer. We never take card details through this site.
  • If your organisation requires a purchase order, please supply it with your quote acceptance.

Late payment

If an invoice is still unpaid 30 days after its date, we may charge statutory late-payment interest — 8% a year above the Bank of England base rate, calculated daily on the overdue amount — plus a fixed one-off recovery compensation of £40 for debts under £1,000, £70 for debts up to £9,999.99, or £100 for debts of £10,000 and above. We will always send a reminder first, and we decide case by case whether to apply or waive these charges.

Content and approvals

You supply the scientific and clinical content for your projects, and you confirm that anything you send us is approved for use. Our approval covers the creative work — layout, artwork, animation and delivery quality. It is not medical, scientific or regulatory approval, and it does not replace your own review of the accuracy of the content.

Please do not send identifiable patient data. Nothing we do here needs it, and it would create extra risk for you.

Files and safety checks

Files you and we upload are private to your project. Before a proof image or delivery file is stored, it is checked by an external virus-scanning service, and only clean files are kept. Anything that fails the check — or cannot be checked — is refused rather than stored.

Who owns the work

  • Your materials. You keep ownership of everything you supply — content, data, brand assets, logos and reference material — and you confirm you have the rights to supply it. We use it only to deliver your project.
  • Final deliverables. Once we have received payment in full, the copyright in the final approved deliverables created specifically for you is yours. Until then, proofs and deliverables are for your review only.
  • What stays ours. We keep our working methods, templates, tools, unused concepts and rejected designs. Where these are built into your final deliverables, you get a permanent licence to use them as part of those deliverables.
  • Third-party items. Stock images, fonts, music, footage and similar items stay subject to their own licence terms, which we pass on to you. Any extra licence fees appear in your quote.
  • Specialists. Where specialists contribute to your project, we secure from them the rights needed so we can pass them on to you. You deal with Mighty only.
  • Portfolio. We only show your work in our portfolio, on our website or in award entries with your written permission, and never before it is publicly released. You can withdraw permission for future use at any time.
  • Moral rights. Where the law allows, our team waives moral rights in the final deliverables so you can adapt them.

Our responsibility to you

  • Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
  • You are responsible for the accuracy and approval of the content you supply, and for final sign-off before use. We are not responsible for loss arising from errors in content you supplied or approved, or from using work without your own medical, legal or regulatory review.
  • We are not liable for loss of profit, business, goodwill or data, or for any indirect or consequential loss.
  • Our total liability for any project is limited to the fees paid or payable for that project.
  • Please keep your own copies of the materials you send us. If something we hold is lost or corrupted, our responsibility is to re-supply what we hold with reasonable care.
  • We are not responsible for delays caused by late content, feedback or approvals, or by events outside our reasonable control.
  • You will cover claims brought against us by third parties because material you supplied infringes their rights or is unlawful.
  • Please tell us about any claim within 12 months of becoming aware of it.

These two sections are new and written in plain language; our solicitor is checking them before they become final contract wording.

A note on this page

This page is written in plain language and reflects how we actually work today. Before you rely on it as a contract, we recommend your own solicitor or accountant reviews it — particularly if you work outside the UK.
